Former president Donald J. Trump has signaled his next move with regards to the illegal search of his home by armed agents of the United States government. He posted the following on Truth Social:
“A major motion pertaining to the Fourth Amendment will soon be filed concerning the illegal Break-In of my home, Mar-a-Lago, right before the ever-important Mid-Term Elections. My rights, together with the rights of all Americans, have been violated at a level rarely seen before in our Country. Remember, they even spied on my campaign. The greatest Witch Hunt in USA history has been going on for six years, with no consequences to the scammers. It should not be allowed to continue!"
The Wall Street Journal said this week that Trump had every legal right to possess the documents that were taken from his home:
"The warrant itself suggests the FBI had no legally valid cause for the raid."
It was a general-issue warrant that violates the 4th Amendment protection against illegal searches. The government was on a fishing expedition. Agents were hoping to find anything that could be used to criminally indict the former president.
The cover story is that the Justice Department was seeking classified documents. The Biden administration, which denied having any knowledge of the search, actually informed the Attorney General in April of boxed documents that were delivered to Trump's home.
The boxes were filled and sealed by the General Services Administration. It's not as if Trump physically walked out of the White House with papers stuffed in his pants in the manner of President Clinton's National Security Chief Sandy Berger.
In June, government agents visited Trump's home, examined the documents and requested that he store them in a locked room. The agents were given full access and cooperation. They could have removed the papers then, or formally requested a subpoena to take legal possession.
The Attorney General said the raid was necessary because of non-compliance, but that charge has been disputed by Trump's lawyers who said that the government could have requested the documents at any time.
The matter hinges on whether the papers are classified or, as Trump claims, declassified. According to the Constitution the president has the right to declassify a classified document.
The warrant, however, did not specify what papers the government was seeking -- most likely because it doesn't want the American public to know the level of corruption at the Department of Justice and Federal Bureau of Investigation.
Before he left office, Trump threatened to declassify all of the phony documents that perpetrated the Russian Collusion hoax. That would not be good PR for America's Gestapo.
The chain of events seems to suggest that the raid on Trump's home was a CYA operation to protect high-ranking government officials who conspired to keep Trump out of office.
The guilty most surely don't want Trump to return so the witch-hunt will only intensify through 2024.
